Phanthy User Agreement

Dear User, welcome to use Phanthy products and services!

Phanthy products and services are jointly owned and operated by 4Paradigm (Beijing) Technology Co., Ltd. and its affiliated companies (hereinafter referred to as "we" or "Phanthy Operator"). Before using this service, you must carefully read and understand this "Phanthy User Agreement" (hereinafter referred to as "this Agreement") and other related agreements, policies, or guidelines of this platform. When you use a specific function of this service (such as professional model Q&A, internet search, etc.), there may be separate agreements, relevant business rules, etc. (hereinafter referred to as "Specific Agreements") for that specific function. In case of conflict between this Agreement and a Specific Agreement, the provisions of the Specific Agreement shall prevail. All aforementioned terms and rules constitute an inseparable part of this Agreement (collectively referred to as the "Entire Agreement") and have the same legal effect as the main body of this Agreement.

We specifically remind you to carefully read (minors under the age of 18 should read with the accompaniment of a legal guardian) and fully understand all terms of the above agreements, especially the bolded terms, before using this service. When you agree to this Agreement by clicking "confirm," checking a box on the web page, or by actually using this service, it means that you and we have reached an agreement on the Entire Agreement, and you have accepted all the terms and conditions of application, and agree to be bound by the Entire Agreement. If you do not agree to any content of the Entire Agreement, or cannot accurately understand our interpretation of the terms of the Entire Agreement, please click "disagree" or stop using this service.

1. Service Content

1.1 Our products and services include the products and services we provide to you in the form of web pages, applications (which may include different versions), mini-programs, software development kits (SDKs) for use by third-party websites and applications, application programming interfaces (APIs), and innovative forms that emerge with technological development, including but not limited to a general dialogue platform centered on generative artificial intelligence services, as well as specialized vertical Q&A services integrated into the platform (such as specialized Q&A modules for model technology, industry knowledge, etc.) and other functional platforms (hereinafter referred to as "Phanthy" or "the Service").

1.2 The generative artificial intelligence products and services we provide are based on the Phanthy Large Language Model. The Phanthy Large Language Model is developed based on deep neural network algorithms, undergoing stages such as large-scale self-supervised pre-training and targeted optimization training. This model can predict the next token by encoding and calculating input information (including text, images, files, etc.), thereby possessing capabilities such as text generation and dialogue. It can proficiently execute a wide range of different tasks based on text generation and can be integrated into various downstream systems or applications. Specifically, in Phanthy product services, the model generates corresponding content as a response (hereinafter referred to as "Output" or "Generated Content"), including text, tables, and code, based on user input information (hereinafter referred to as "Input") through computational inference. In particular, we provide a "Network Search" function. When this function is enabled, the product will first retrieve public information from the internet according to the input information and instructions, and then generate content based on the retrieved public information. Users can evaluate the Output, including operations such as "like" or "dislike," to provide feedback on the Output information from Phanthy.

For information on the filing status and basic principles of the Phanthy model and algorithm, please refer to the "Phanthy Model Principles and Training Method Description."

1.3 With the continuous iteration and development of generative artificial intelligence technology, models, and products, as well as changes in laws and regulations, we may add, upgrade, change, suspend, or terminate the Service, or make necessary adjustments to the technology, method, or performance of the Service, and may conduct internal or external tests for new service functions.

1.4 We will take necessary measures no less than industry practice to ensure the network security and stable operation of the platform, and strive to improve and enhance technology to ensure your product and service experience. If you have any questions or feedback about our Service, you can contact us through the methods specified in Article 10.

2. Account Management

2.1 The Service is primarily aimed at adults. If you are under the age of 18, please read this Agreement with the accompaniment of a legal guardian and use the Service only after obtaining the consent of your legal guardian. The Phanthy Operator fully understands the importance of protecting minors and will take corresponding protective measures in accordance with the requirements of laws and regulations and mainstream industry practices. At the same time, guardians are requested to reasonably guide and restrain the use of the Service by minor users, jointly create a good network environment, help minors develop good online habits, and avoid excessive dependence or addiction to the Service.

2.2 Before using the Service, you should register an account via mobile phone number or a third-party account according to the page requirements, fill in true, accurate, legal, and valid relevant information, and confirm your agreement to this Agreement and other relevant rules and policies. If the materials you submit or the information you provide are inaccurate, untrue, non-standard, or if the company has reason to suspect that the information is incorrect, untrue, or illegal, we have the right to refuse to provide you with relevant functions, and you may not be able to use this software and related services or some functions may be restricted during use. Your account is the credential for you to log in and use the Service, and the account is non-transferable, non-giftable, and non-inheritable.

2.3 When registering and using an account, you must promise and guarantee:

  1. To assume full responsibility for the truthfulness, legality, and validity of the registration information, and to update the registration information in a timely manner, and not to register an account or use the Service in the name of others;
  2. To properly keep your account and password, and to assume legal responsibility for all actions under that account;
  3. Not to maliciously register accounts, including but not limited to frequent registration, batch registration, and other behaviors;
  4. Not to transfer, lend, rent, or provide the account to others for use in any form.

2.4 If you lose your account, forget your password, or disclose your verification code, you can appeal in time to retrieve it. We specifically remind you to properly keep your account, password, and verification code. When you finish using the Service, you should log out safely. You shall bear the corresponding responsibility for various losses caused by the leakage of the account or password. If a user discovers any illegal use of the user's account, they should immediately notify us, and we will provide maximum cooperation and handling.

2.5 If a user requests to cancel their account, and we approve the request after review, we will cancel the registered user, and the user will be released from the contractual relationship with us. However, after the user cancels the account, we still have the right to:

  1. Retain the user's registration data and previous behavior records in accordance with the requirements of laws and regulations;
  2. Exercise the rights stipulated in this Agreement for any illegal behavior or violation of this Agreement by the user during the use of the Service before the cancellation.

3. Usage Specifications

3.1 You fully understand and agree that, according to this Agreement, we grant you a revocable, non-transferable, and non-exclusive right to legally use this product and related services. All other rights not expressly authorized by this Agreement are reserved by the Phanthy Operator. You must obtain written permission from the Phanthy Operator before exercising these rights. At the same time, the Phanthy Operator's failure to exercise any of the aforementioned rights does not constitute a waiver of that right. If you publish or disseminate the Output generated by the Service externally, you should: (1) actively verify the truthfulness and accuracy of the Output content to avoid disseminating false information; (2) clearly indicate in a prominent manner that the Output content is generated by artificial intelligence to alert the public to the content synthesis; (3) avoid publishing and disseminating any Output content that violates the usage specifications of this Agreement.

3.2 When using the aforementioned services provided by us, you should comply with the requirements of laws and regulations and the stipulations of this Agreement, adhere to the principles of voluntariness, equality, fairness, and good faith, not use the Service to infringe upon the legitimate rights and interests of others or seek improper benefits, and not disrupt the normal order of the internet platform.

3.3 As a user of the Service, you shall not violate the requirements of the "Administrative Measures for Internet Information Services," "Regulations on the Governance of the Internet Information Content Ecosystem," "Interim Measures for the Management of Generative Artificial Intelligence Services," "Measures for the Identification of Artificial Intelligence Generated Synthetic Content," and other laws, regulations, and relevant standards regarding network information content security, and shall not input, use the Service to output, or disseminate the following illegal and undesirable information:

  1. Opposing the basic principles established by the Constitution;
  2. Endangering national security, divulging state secrets, subverting state power, or undermining national unity;
  3. Harming national honor and interests;
  4. Distorting, defaming, blaspheming, or denying the deeds and spirit of heroes and martyrs, or infringing upon the names, portraits, reputations, or honors of heroes and martyrs through insult, slander, or other means;
  5. Advocating terrorism, extremism, or inciting the implementation of terrorist activities or extremist activities;
  6. Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
  7. Undermining the state's religious policies, or promoting cults and feudal superstitions;
  8. Spreading rumors, or disrupting economic and social order;
  9. Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crimes;
  10. Insulting or slandering others, or infringing upon the reputation, privacy, and other legitimate rights and interests of others;
  11. Other content prohibited by laws and administrative regulations.

3.4 To fulfill statutory obligations, the Phanthy Operator has the right to take technical means and other measures to review the user's behavior and information when using the Service, including but not limited to reviewing Input and Output, establishing a risk filtering mechanism, and establishing a feature library for illegal content. As a user of the Service, you shall not maliciously confront the information content security management and risk prevention mechanism of the Service through the following means, including but not limited to:

  1. Malicious confrontation behavior, including but not limited to using variants, garbled characters, symbols, homophones, etc., to circumvent service detection to input or generate remarks that violate the above 3.3.
  2. Conducting malicious attacks, inducement, and poisoning through impersonation, reverse induction, jailbreaking attacks, and other means.
  3. Unauthorized removal or alteration of the generated content identification involved in the Service without the consent of the Phanthy Operator or without legitimate and proper grounds.

3.5 As a user of the Service, you shall not violate the requirements of the "Cybersecurity Law," "Data Security Law," and other laws, regulations, and relevant standards, and shall not interfere with, damage, or attack the Service and the systems, networks, models, and other components that support the normal operation of the Service, and shall not engage in the following activities that endanger the security of the Service:

  1. Engaging in activities that illegally intrude into the network, such as: using unauthorized data or accessing unauthorized servers/accounts; forging TCP/IP data packet names or parts of names; attempting to probe, scan, or test the weaknesses of this software system or network without permission, etc.
  2. Engaging in activities that interfere with or disrupt the normal function of the network, such as: deliberately generating or spreading malicious programs or viruses; accessing public computer networks or other people's computer systems without permission and deleting, modifying, or adding stored information; interfering with operations in a way that causes the computer system or facility to bear an unreasonable load, etc.
  3. Engaging in activities that steal network data, such as: reverse engineering, reverse assembly, reverse compilation, translation of this software and related services, or otherwise attempting to discover the source code, model, algorithm, and system source code or underlying components of this software; crawling or copying the Service and any content contained therein in any way (including but not limited to through any robot, spider, other automatic settings, or setting up mirrors), etc.
  4. Engaging in other activities that endanger the security of the Service system, network, model, and other components.

3.6 As a user of the Service, you shall not use the Service for the following improper purposes:

  1. Using the Service for any illegal purpose that violates laws, regulations, regulatory policies, or infringes upon the legitimate rights and interests of third parties.
  2. Using the Service for dangerous purposes that may cause serious harmful effects on personal health, psychology, society, or economy, or violate scientific and technological ethics.
  3. Engaging in acts that infringe upon intellectual property rights, trade secrets, and other acts that violate business ethics, or using the advantages of algorithms, data, platforms, etc., to implement monopolies and unfair competition.
  4. Copying, transferring, renting, lending, selling, or providing sub-licenses or re-licenses for all or part of the Service without the authorization of the Phanthy Operator.
  5. Using the Service to engage in or assist in high-risk activities, such as: military and warfare, development of weapons, explosives or dangerous materials, management or operation of critical infrastructure (such as transportation, energy), creation or distribution of controlled substances or services, generation or dissemination of information related to self-harm, activities with a high risk of economic damage, including gambling, automatic determination of credit qualifications, employment, and education decisions.
  6. Other uses prohibited or restricted by laws and administrative regulations, or that may harm the interests of the Phanthy Operator.

4. Input and Output

4.1 You are responsible for all Input submitted to our Service and the corresponding Output. You declare and warrant that you have all the rights, licenses, and permissions required to process the Input according to our terms, and that the Input and corresponding Output do not infringe upon the intellectual property rights, portrait rights, reputation rights, honor rights, name rights, privacy rights, personal information rights, and other legitimate rights and interests of any person, and do not involve any state secrets, commercial secrets, or other data that may cause adverse effects on national security or public interests.

4.2 Subject to compliance with laws and our terms, you enjoy the following rights to the Input and Output of the Service: (1) You retain any rights, title, and interest (if any) you have in the submitted Input; (2) We attribute any rights, title, and interest (if any) in the content Output by the Service to you. (3) You can apply the Input and Output of the Service to a wide range of usage scenarios, including personal use, academic research, derivative product development, training other models (such as model distillation), etc. However, you understand and agree that the content obtained through the network search or specialized vertical Q&A function may contain information from third-party sources, and your use of such content should comply with relevant third-party agreements and legal regulations.

4.3 To provide you with continuous and high-quality services, under the premise that the data is processed with security encryption technology, strictly de-identified, and cannot re-identify specific individuals, we may use the Input and corresponding Output collected by the Service for model training and service optimization. Under this premise, you agree to grant the Phanthy Operator a free, non-exclusive license to use the aforementioned content globally, so that we can process the aforementioned content. If you refuse to have your data used for model training, you can choose to opt out by turning off "Data used for experience optimization" within the product. After turning it off, your Input and Output will no longer be used for our model training.

4.4 Based on the technical characteristics of large language models and artificial intelligence, the Output of the Service is random and cannot guarantee uniqueness. Therefore, you understand and agree that we may output the same or similar generated content to different users, and may also generate different content results for the same content uploaded to the Service platform.

4.5 When using the "Session Sharing" function, if the session content you share with others is publicly published on the public network, there may be a risk of being obtained by third parties through technical means such as web crawlers. We have adopted industry-standard anti-crawler mechanisms (Robots Protocol) to make commercially reasonable efforts to prevent third parties from crawling the content publicly shared by users. However, due to the technical limitations generally existing in the industry, this risk cannot be completely eliminated. Therefore, we recommend that when using this function: (1) Avoid inputting or sharing your or others' personal information, especially sensitive personal information; (2) If you must input or share others' personal information, you must obtain their explicit authorization in advance; (3) Before publicly publishing the relevant session to the public network, please carefully identify whether there is any information you do not want third parties to know.

5. Inaccuracy of Output and Identification Rules

5.1 All Output provided by the Service is answered by the artificial intelligence model and does not constitute a legal expression of intent by the Phanthy Operator; it may contain errors or omissions and is for your reference only. You should not use the Output content as professional advice. In particular, when you use the Service to consult on medical, legal, financial, and other professional issues, please note that the Service does not constitute any advice or commitment, nor does it represent the opinions in any professional field. If you need relevant professional services, you should consult a professional and make decisions under the guidance of a professional. The Output of this software should not be the basis for your further actions or inactions. You shall bear all consequences and responsibilities arising from any judgment you make based on the Output content or subsequent related operations, including the risks arising from reliance on the truthfulness, accuracy, reliability, non-infringement, or fulfillment of specific purposes of the Output content. You should scientifically and rationally understand and legally use generative artificial intelligence technology.

5.2 When you enable the "Network Search" function of the product, it may, to a certain extent, improve the accuracy and timeliness of the generated Output content. However, due to the current model principles and technical level, the inaccuracy of model-generated content is a common problem generally existing in the industry and cannot be completely avoided. Therefore, you should rationally understand and use our products and services in accordance with the relevant terms in Chapter 5.

5.3 To implement the requirements of the "Measures for the Identification of Artificial Intelligence Generated Synthetic Content" and the national standards such as "Cybersecurity Technology - Identification Method for Artificial Intelligence Generated Synthetic Content," and to prevent confusion and misidentification and reduce the potential impact of inaccurate generated information, Phanthy has added identification to the content generated by the artificial intelligence model on the platform and clearly reminds users that the relevant content is generated by the artificial intelligence model. You shall not delete, tamper with, forge, conceal, or attempt to circumvent such generated content identification, and shall not use the Service to create or disseminate false information, infringing information, or engage in any illegal or non-compliant activities. Any form of damage to the generated content identification added by default to the Service may lead to you bearing corresponding legal liabilities.

6. Intellectual Property and Other Rights

6.1 The Phanthy Operator is the developer and operator of the Service and enjoys all rights (including but not limited to copyrights, trademark rights, patent rights, and other intellectual property rights) within the scope permitted by laws and regulations for the Service (including but not limited to software, technology, programs, code, model weights, user interface, web pages, text, charts, layout design, trademarks, electronic documents, etc.), except for the rights that relevant right holders should enjoy in accordance with legal provisions or the stipulations of this Agreement (such as Input and Output).

6.2 Without our permission, please do not unauthorizedly use any trademarks, service marks, trade names, domain names, website names, company logos (LOGO), URLs, or other prominent brand features related to this product, including but not limited to "Phanthy." You shall not display, use, or apply for trademark registration, domain name registration, etc., for the aforementioned marks in isolation or in combination in any way, nor shall you implement acts that explicitly or implicitly suggest to others that you have the right to display, use, or otherwise handle these marks.

7. Complaints and Feedback

Please note that all Output provided by the Service is generated by the artificial intelligence model, not a customer service representative's reply. Therefore, if you believe that the Service involves infringement of your intellectual property rights or other rights, or if you find any illegal, false information, or usage behavior that violates this Agreement, or if you have any opinions or suggestions about our Service, you can submit them through the product interface - view avatar - click the "Contact Us" button, or provide feedback to us truthfully through our public contact email and address. We will attach great importance to your opinions and take handling measures in accordance with the law.

8. Liability for Breach and Limitation of Liability

8.1 For your violation of this Agreement or other service terms, we have the right to independently judge and take disposal measures such as warning reminders, setting a time limit for correction, restricting account functions, suspending use, closing the account, prohibiting re-registration, and deleting relevant content without notice to you. We have the right to announce the handling results and the right to decide whether to restore use based on the actual situation. For behaviors suspected of violating laws and regulations or suspected of illegal crimes, we will retain relevant records and report to the relevant competent authorities and cooperate with the investigation of the relevant competent authorities in accordance with the law. You shall bear the legal liabilities or any claims, demands, or losses asserted by third parties arising therefrom; if this causes any loss to us, you shall also compensate (including litigation fees, arbitration fees, attorney fees, notarization fees, announcement fees, appraisal fees, travel expenses, investigation and evidence collection fees, compensation, liquidated damages, settlement fees, fines for administrative penalties, etc., incurred by us for safeguarding our rights).

8.2 We are committed to providing safe, stable, and continuous services to ensure the normal use of users, but the Service is only provided "as is" and "with current functions." Although we have made our best efforts, due to the inherent technical bottlenecks and objective limitations of the technology on which the Service relies, we cannot make any guarantees regarding the following matters:

  1. We do not guarantee that the operation of the Service will be uninterrupted, error-free, undisturbed, continuously stable, or free of any faults;
  2. We do not guarantee the ability to correct all defects of the Service under the existing technical level;
  3. Limited by technical characteristics, we do not guarantee the legality, truthfulness, completeness, accuracy, timeliness, and practicality of the content generated by the Service, and we do not rule out the possibility that the Output may contain content inconsistent with the views of the Service operator due to malicious inducement through prompt words or other usage methods/purposes that violate this Agreement;
  4. Although the Input and Output of the Service have been filtered and reviewed, we still cannot rule out the possibility that we may not be able to discover violations in your Input or the Output of the Service, and we do not rule out that some of the information may have flaws, contain false content, or be unreasonable or cause user discomfort;
  5. Due to the characteristics of the artificial intelligence model, the Service may generate different content results for the same content uploaded to the Service platform (including but not limited to text as prompt words or all other prompt content used to assist in generating artificial intelligence generated content);
  6. We do not guarantee that the Service can meet all user requirements.
  7. When the content provided by the Service includes content from plug-ins, third-party websites, or specialized vertical Q&A links, we are not responsible for the effectiveness of this content, and we do not guarantee the truthfulness, legality, or safety of any content, products, services, or other materials obtained from these channels.

8.3 Under no circumstances shall the Service be liable for the inability to access the Service, service interruption, leakage, delay, stagnation, or error of information and data, or the inability to provide or delayed provision of services due to network connection failures, power failures, strikes, labor disputes, riots, insurrections, civil unrest, fires, floods, storms, explosions, force majeure, wars, government actions, orders of international or domestic courts, hacker attacks, internet viruses, technical adjustments by network operators, temporary government control, or any other reasons beyond reasonable control.

8.4 We may launch new functions from time to time. We remind you that the Service may be unstable during the testing period of new functions. Except as expressly provided by law, we cannot and do not guarantee the stability of the functions and services during the testing period.

8.5 Unless otherwise specified on the relevant interface of the Service, or otherwise agreed upon by you and us, or expressly provided by law, we shall not be liable for damages caused to you by the use of the Service.

8.6 The Service may contain links to third-party websites or specialized vertical Q&A services. Such links are only provided for your convenience. Your access to third-party websites and subsequent operations are irrelevant to us, and we are not responsible for the content or services of third-party websites. Please visit with caution, pay attention to checking their agreements or documents, and protect your information and property security.

9. Governing Law and Jurisdiction

9.1 The conclusion, execution, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China.

9.2 In the event of a dispute arising from the signing, performance, or interpretation of this Agreement, both parties shall strive to resolve it through friendly negotiation. If the negotiation fails, either party has the right to file a lawsuit with the court having jurisdiction over 4Paradigm (Beijing) Technology Co., Ltd.

10. Miscellaneous

10.1 To provide you with better services or to meet the needs of changes in national laws and regulations, policy adjustments, technical conditions, product functions, etc., we will revise this Agreement from time to time, and the revised content constitutes a part of this Agreement. The updated Agreement will be announced through appropriate means such as the official website or service page. Once announced, it will replace the original agreement terms. Please check the latest version of the agreement terms on the official website yourself. If you do not accept the revised Agreement, please stop using the Service immediately. Your continued use of the Service will be deemed as your acceptance of the revised Agreement.

10.2 If you find any illegal or non-compliant behavior or behavior that violates this Agreement, or if you have any opinions or suggestions about this Agreement or the Service, you can contact us through the following methods, or directly contact our staff:
